Swiss Skydive privacy policy

Swiss Skydive (SSD) is aware of its responsibility in handling data and is committed to the correct handling of your data in accordance with Swiss data protection laws, taking into account the European GDPR.

This privacy policy describes the general data protection procedures. This includes the collection, processing, use and disclosure of personal data of our members and users of the websites.

Why and how is your personal data collected and used?

Access to websites and online services

In order to open one of our websites or use an online service, information is stored that is required for access, operation of the website and compliance with technical and legal requirements in connection with the operation of our website. This includes, for example, passwords, IP address and web browser settings, which are stored anonymously for the duration of a session.

Information, ordering or support

When you contact us (online or offline), we collect the information we need to fulfill your request and provide you with access to the relevant product or service. For example, we collect your name and contact information, details of your request, your agreement with us and the fulfillment, delivery and billing of your order. You must be registered to order most services and products. By registering, you can also view and adjust your personal data at any time.

Use of personal data

The information we collect about you comes from our direct interactions with you. When you register for an event or course, we may collect information (online or offline) in relation to the
event organization. We combine the personal data collected in order to carry out our association activities and services to our members in accordance with our Articles of Association. The personal member data is stored centrally in a database. Disclosure, if at all, is centrally controlled and documented. The use of personal data is restricted. For example, it is only used for communication with registered members or partner associations, such as sending necessary member data to the FAI when an FAI licence is applied for, as well as registration data for events and championships to organizers or to synchronize member data with the umbrella organization AeCS. Consent to the use of the data for the aforementioned purposes is given by the members when registering.

Security and quality of information

We are committed to protecting your personal data and ensuring its accuracy. SSD has implemented physical, administrative and technical safeguards to protect your personal information from unauthorized access, use and disclosure. For example, certain particularly sensitive personal data (e.g. credit card details or passwords) is encrypted when it is transmitted over the Internet. We also require our partners to protect this data from unauthorized access, use and disclosure.

Storage period

Personal data will not be kept longer than necessary to fulfill the purposes for which it is processed, including the fulfillment of legal or regulatory obligations (e.g. auditing, billing and statutory retention periods), the handling of disputes and the establishment, exercise or defense of legal claims.

Rights and contact

You can request information about your personal data. You also have the right to object to direct marketing.

You may have additional rights under the law applicable to you in relation to data processing. For example, if the processing of your personal data is subject to the provisions of the GDPR and your personal data is processed based on legitimate interest, you have the right to object to the processing on grounds relating to your particular situation. Under the GDPR, you also have the right to request the erasure, restriction of processing and transfer of your personal data.

GENERAL TERMS AND CONDITIONS

for trade via the ONLINE SHOP of Swiss Skydive

for Switzerland and the Principality of Liechtenstein

  1. Scope of application
    These General Terms and Conditions (hereinafter referred to as 'GTC') shall apply to all contracts concluded by Swiss Skydive, HR number, with persons or companies residing or domiciled in Switzerland or the Principality of Liechtenstein (hereinafter referred to as 'Customer') for products offered in the Swiss Skydive webshop (hereinafter referred to as 'Webshop') (hereinafter referred to as 'Products'). By placing an order in the Swiss Skydive webshop, the customer accepts these GTC.

Deliveries, services, offers etc. of Swiss Skydive via the webshop shall be made exclusively in accordance with these GTC. The GTC shall apply in the version valid at the time of the conclusion of the contract. Swiss Skydive reserves the right to change these GTC at any time.

  1. User account / details of the customer

The customer places orders via a user account or as a guest in the Swiss Skydive webshop. All information provided by the customer in the user account and all information provided as a guest must be complete and true. Each customer may only open one user account.

  1. Conclusion of contract and delivery

The contract between Swiss Skydive and the customer is only concluded by an explicit order confirmation (not by the automated summary of the order sent by email) or by the shipping confirmation from Swiss Skydive and is subject to the availability of the ordered products. The buyer shall remain bound by the order until the time of the express order confirmation or the shipping confirmation by Swiss Skydive.
Swiss Skydive's offer is primarily aimed at end consumers, which is why Swiss Skydive reserves the right not to fulfill or reject orders, in particular if, in Swiss Skydive's view, quantities of products that are not customary for end consumers are ordered.
The prices in Swiss francs, including VAT, valid on the order date and stated in the web store shall apply to the products ordered by the buyer. The shipping costs are shown separately during the order process and in the order confirmation.
Swiss Skydive delivers exclusively to delivery addresses within Switzerland or the Principality of Liechtenstein. The shipping route and type of packaging shall be determined by Swiss Skydive.
Delivery dates and/or deadlines specified or communicated by Swiss Skydive are non-binding. If the delay is more than twenty days or if delivery is impossible for more than twenty days, the customer and Swiss Skydive shall be entitled to withdraw from the contract without compensation.

  1. Terms of payment

All orders must be paid in Swiss francs, either by invoice or by credit card.
Invoices from Swiss Skydive must be paid within 30 days (without deduction). After the third reminder, Swiss Skydive shall charge a handling fee of CHF 40.00.
In the case of orders against invoice, Swiss Skydive shall be entitled to demand advance payment without giving reasons (e.g. insufficient creditworthiness).
In the case of payment against invoice, ownership of the delivered goods shall not pass to the customer until the purchase price has been paid in full.

  1. Inspection, warranty and liability

The customer shall immediately check the received shipments or products for correctness, completeness and freedom from defects. Any deviations from the order and any defects must be reported to Swiss Skydive in writing within 5 calendar days of delivery.
Defective products must be returned to Swiss Skydive.
The shipment must be sent to the following address: Swiss Skydive, Fischingerstrasse 66, 8370 Sirnach, Switzerland. Costs of packaging and shipping shall be borne by the customer.
The warranty obligation may be fulfilled by Swiss Skydive at its own discretion by repair, replacement (by an identical or similar product), reduction of the purchase price or refund of the purchase price. Other services, in particular compensation for damages, are excluded in the event of a defect.
With the purchase, the customer undertakes to use the products solely for their intended purpose.

Any further liability of Swiss Skydive in connection with products or services of Swiss Skydive and its auxiliary persons shall be excluded to the extent permitted by law.

  1. Data security and data protection

Data is transmitted via the Internet. The Internet is an open network that can be accessed by anyone and is therefore not generally considered a secure environment. All payment transactions are processed according to the security standard customary at the time of the transaction (https://). Swiss Skydive accepts no liability for the security of data during its transmission via the Internet.
Personal data is processed in accordance with and in compliance with the applicable data protection regulations for the purpose of processing the contract and maintaining the relationship with the customer (including marketing measures).
The customer's personal data is only passed on to third parties outside the Swiss Skydive Group to the service partners involved in the execution of the contract, such as the logistics company commissioned with the delivery. In such cases, the scope of the transmitted data is limited to the minimum necessary for the execution of the contract. There is no further transfer of customer data to third parties. The customer agrees to the collection, processing and use of their personal data in accordance with the aforementioned information.
Furthermore, the conditions for the use of the webshop website, which can be accessed under the heading Data protection, also apply to buyers.

  1. Applicable law and place of jurisdiction

The contractual relationship, including these GTC, shall be governed exclusively by Swiss law, excluding the conflict of laws provisions of Swiss private international law, in particular excluding the United Nations Convention on Contracts for the International Sale of Goods (Vienna Sales Convention). The place of jurisdiction shall be Lucerne, Canton of Lucerne, Switzerland, whereby Swiss Skydive shall also be entitled to sue the customer at the customer's general place of jurisdiction.
